VOTE TO REGULATE ROADWAYS

The Country Place Community Master Association Board of Directors is asking for your input on an important vote that will affect how we manage parking and road use in our neighborhood.

This vote is necessary because a new law, Arizona House Bill 2298, went into effect in October 2023. The law changes how communities like ours, with rules created before 2015, can enforce parking and roadway regulations on public streets. The Board has determined that this law applies to our community as:
  • The Declaration was recorded before January 1, 2015, because the Declaration of Covenants, Conditions, and Restrictions for Country Place Community Master Association Community Association (the “Declaration”) was recorded in 2000; and
  • The Declaration restricts vehicles from being parked or stored on public streets. See Article 4, Section 4.3.26 & 4.3.27 of the Declaration; and 
  • The Association currently has the authority to restrict trash containers, bulk trash, rubbish/debris materials on the curbs or sidewalks and street areas; and
  • The Association currently has the authority to restrict signage placed in street medians.
COMMUNITY SUPPORT:
 
A.R.S § 33-1818 requires us to hold a vote before June 30, 2025, to decide if the Association should continue to regulate parking and other rules on public streets in our community. This vote is important because the Association currently has rules that limit parking on the streets. The Board can adopt rules that can better control and protect our public roadways. Additionally, the Association can regulate things like signs in the medians and prevent bulk items or trash cans from being left on public sidewalks and roads.
 
Your vote will help shape the future of these regulations.
 
If this vote passes, the Association will keep its current authority to regulate public roadways in the community. 
 
If the vote fails, the Association will no longer have the authority to regulate public roadways in the community.
 
Voting options and how to cast your vote will be sent out as we get closer to the May 2025 Annual Meeting. The vote will be included on the 2025 Annual Meeting ballot, and online voting and paper ballot options will be available.
